Hello

I have a CC debt from approx 4yrs ago, i requested a CCA from the Bank concerned and they sent another CCA to fill in as they had lost it, (i did not fill it in) as i was concerntrating in trying to pay the most important debts at the time, all went quite until about 2 mths ago, where a DCA has seemed to get hold of it.

They asked for payment, i replied by sending the £1 and a request for the CCA, twice now they have returned the £1 saying that they do not have the facility to get the CCA (no suprise there then)

Today they send a A4 envelope with a picture of the house i am renting, and demanding payment within 3 days, or court action and bailiffs will be paying a visit. can they do this without the CCA?

I am really struggling to make ends meet at the moment what with wage cuts. and everything else rising, what can they do please?

from what i have found out about DCA's, they try to bully and scare people into paying debts- the photo of your home will be just another way of getting you to pay up as a debt collector cannot enter your home.

They say there sending Bailiffs, but here's non in Scotland (messenger at arms is the equivelant, up here)

have they said 'will' or 'may'?

they are very clever at how they word letters etc tis all designed to get you to pay up straight away.

i don't really know much about it, but i think a bailiff only gets sent out if the case has gone to court but i could be wrong.

the people on this forum are really great with their advice and i'm sure someone with more knowledge will reply to your post

Stuff and nonsense. In the words of Jim Royle Baillifs my a**se :wink: We tend to cut them off at Hadrian's wall. They need to take court action before they do anything.And as Shadowz says the letter will probably say "may".

I would take the snotty letters they sent you straight to your Trading Standards Office and report them for their tactics. While your CCA is in dispute they cannot take enforcment action.

It is very likely they know this, hence they are trying to scare you.Half of them don't actually know the law, and spend their time trying to find ways to wind you up.

I know this-because I have ex DCA rellies and friends (none work in the industry now, due to their tactics), but this sounds typical behaviour.
