Hi all

Ive decided to go bankrupt and need some advice, all replies appreciated.

Someone told me that if i dont seek professional advice first, the judge can not allow bankrupcy, is this true?

Secondly, i was going to see the CAB, but to see them you have to go to a drop in center and wait in line, then when you speak to someone, they will make an appointment for a further date with a debt advisor, this sounds ok but my problem is, theres not a lot of work in the part of the uk where i live, i have a job through an employment agency, they have said if i take any time off they will just get someone else to take my place, so i really cant go down to the cab and wait and then come back for a further appointment. Is there any other helpline or charity that i can book an appointment with rather than this drawn out process with the CAB. Sorry for waffling, but i need to do this, but darent take time off incase i lose my job.

I am due to go the my bankruptcy hearing this coming thursday.

I found it next to impossible to get through to anyone in my local CAB and had the same issue.The court clerk asked me when booking my appointment if I had sat down with anyone with regards advise etc and at that time I said "NO". She would not then give me an appointment.

So basically I went away and had a short telephone conversation with The Insolvency Service so that I could say I had taken "reputable" advise.

I then called back and told her and she was happy enough to make my appointment.I think they have to cover themselves and make sure you are fully aware of the implications.

In all honesty 99% of advise and info has come from this site and one other forum. The CAB has a website with information on it and so does The Insolvency Service but like I said everyone is in a different position and this site seems to have most bases covered.

I have learnt a lot in the last month or 2 leading up to BR and will answer any questions I can.(bare in mind I am just a layperson like yourself though).

I am sure all the helpful people on this site will pull me up on anything I am getting wrong.

Thanks for the reply.

So did you just download the forms, fill them in, speak to insolvency service on the phone. Ring the court, book the bankrupcy hearing, then you will pay the fee on the day, and its all done, or have i missed anything out

I know it looks inconvenient, but do make sure you speak to somebody before you do the deed. Just to get a second opinion, if nothing else.

People have a funny way of convincing themselves that bankruptcy is the only way forward, and indeed it is for many -- but not for everybody.

Like nearly everyone on here says, bankruptcy isn't so bad -- but you really don't want to be doing it if you don't have to.

Yes - I downloaded forms - but only after spending around a fortnight researching all the different issues that are going to arise from bancruptcy.

Like I said there isnt much on this forum that you cant find out.

I actually filled forms out manually but will transfer them to the online version in time for this thursday - just more tidy really plus my hand writing is awful.

In my case - its all done on the same day in court.I believe this depends on the court - in some cases you go to the court to hand in paperwork(sign affadavit) on one day and then have another date set for the hearing.

Thankfully myself and my wife will be all done thursday 9.30am. This is also when we pay our £510 each for the privelage.

Anything else then just ask.

Phone NDL, CCCS or Payplan - all three will give you advice on whether bankruptcy is the best option for you - then you can say you have taken advice from someone who has looked at all circumstances..... It does not have to be a CAB and this site can also count but this site does not have the capacity to look at your complete financial situation!

a second opinion is always a good idea.

for example,only two weeks ago i went to visit someone who had decided they definately wanted to go BR. her debts were just over £14k so a debt relief order was a better option and not only that if her hubby applied for a DRO as well, the total cost of the two applications (£180) would be substantially cheaper than one application for BR

you may well have researched thoroughly and BR is the best option for you, but it would satisfy the judge and hopefully you if you get impartial advice as well

At the very least talk to National Debtline and think carefully about going BR. If there are othert options do consider them as BR has lasting consequences as you can imagine.
